1. Introduction
These terms and conditions govern the rental of instruments and related items from Own Tempo Music. By placing an order through the website, you agree to be bound by these terms.
2. About us
Own Tempo Music is a UK business offering instrument rental for learners, families, and returning musicians. Full business and contact details should be displayed on the website.
3. Orders
All orders are subject to availability. After you place an order, you will receive confirmation that it has been received. A contract is formed when we accept the order and arrange for dispatch or fulfilment.
4. Product information
We aim to describe our instruments and rental packages as accurately as possible. However, images, brands, finishes, and minor details may vary where equivalent student-suitable items are supplied.
5. Rental charges and payment
The rental price, any deposit or security fee, and any delivery charges will be shown clearly before checkout. By placing an order, you agree to pay the charges associated with your selected rental arrangement.
6. Minimum term and recurring payments
Where a minimum term applies, this must be stated on the product page or at checkout. If recurring payments are used, the customer authorises those payments in line with the selected rental arrangement.
7. Ownership
All rented instruments remain the property of Own Tempo Music unless explicitly stated otherwise. Rental does not transfer ownership to the customer.
8. Customer responsibilities
Customers must take reasonable care of the instrument and use it only for lawful and appropriate musical purposes. The instrument must not be sold, sublet, pledged, or otherwise dealt with as though it belonged to the customer. Reclamation action will be taken should this occur.
9. Loss, theft, and damage
Customers must inform us promptly if an instrument is lost, stolen, or damaged. We reserve the right to charge for repair, replacement, or related costs where appropriate under the rental agreement. This cost may be up to and including the full cost of replacing the instrument
10. Delivery
Delivery arrangements, dispatch times, and any territorial limitations are set out on the delivery page. Risk in transit remains subject to applicable consumer law and the delivery arrangements used.
11. Cancellations and returns
The process for cancellation and return is set out on the returns page and may also be governed by any product-specific rental conditions. Customers should follow the published return process and any notice requirements.
12. Failure to return
If a customer fails to return an instrument when required, we reserve the right to take reasonable steps to recover the item or recover the value of losses arising from the failure to return it.
13. Website use
We may update the website, pricing, and product availability from time to time. We do not guarantee that the website will always be uninterrupted or error-free.
14. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so. Subject to that, our liability shall be limited to losses that are reasonably foreseeable and arise directly from our breach of these terms.
15. Privacy
Personal information will be handled in accordance with our privacy policy and UK GDPR legislation.
16. Governing law
These terms shall be governed by the law of England and Wales, and disputes shall be subject to the jurisdiction of the courts of England and Wales unless applicable consumer law provides otherwise.
